Worker's Memorial Day by Beau Briggs

Workers' Memorial Day is observed every year on April 28. It is a day to honor those workers who have died on the job, to acknowledge the grievous suffering experienced by families and communities, and to recommit ourselves to the fight for safe and healthful workplaces for all workers. It is also the day OSHA was established in 1971. Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their workers. OSHA's role is to ensure these conditions for America's working men and women by setting and enforcing standards, and providing training, education and assistance.

Davis-Bacon Update by Jerry Pigsley

On February 12, Rep. Paul Gosar (R-Ariz) reintroduced the proposed Responsibility in Federal Contracting Act (H.R. 924).  This bill would amend the Davis-Bacon Act by eliminating the survey process used by U.S. DOL to determine prevailing wage rates.  Gosar noted that the U.S. DOL Bureau of Labor Statistics (BLS) already collects data on national wages and employment.  As a consequence, BLS is the "only agency capable of accurately determining wages" according to Gosar.  He also noted that the current survey process is so inefficient that the prevailing wage in some parts of the country is "as much as 75% higher than the average wage in that area."  In addition, prevailing wages "may be 22% higher than market construction wages" according to Gosar.  Gosar introduced a previous version of the bill in February, 2013 but the bill never made it to the House floor for ... Rebuilding Together Omaha

Rebuilding Together Omaha is a nonprofit volunteer home rehabilitation organization.  Their mission is to help low-income, elderly and disabled who are unable to keep up with home repairs either physically or financially. Associated Builders & Contractors has been involved with this program for the past 15 years.  We have performed electrical and plumbing repairs on dozens of houses and this year our crew of plumbing apprentices worked on three homes installing a new sink and vanity, faucets, sill caulk, and toilet.

Special thanks to Steve Radcliff, Gregurich Plumbing and Aaron Luty, Advantage Plumbing for utilizing their valuable skills to provide a safe environment for clients to live in. With a small contribution of time, materials, and skilled craftsmanship these men are making an impact in our community in a positive way.

How Hard Hats Protect You by Beau Briggs

Hard hats protect you by providing the following features:

A rigid shell that resists and deflects blows to the head.

A suspension system inside the hat that acts as a shock absorber.

Some hats serve as an insulator against electrical shocks.

Shields your scalp, face, neck, and shoulders against splashes, spills, and drips.
Some hard hats can be modified so you can add face shields, goggles, hoods, or hearing protection to them.

Single Employer Update by Jerry Pigsley

On February 3, the NLRB concluded that a construction contractor and another employer are a single employer for the purposes of back pay ordered under the NLRA.  The construction company was found to owe over $122,000 in back pay to former employees who were laid off because of union membership and activities.  The contractor went out of business but until that time leased an office in a building owned and operated by another corporation.  A husband and wife jointly owned 100% of the construction company and each of them owns 50% of the company which owns the building in which the contractor leased an office.  Even though the other company was never involved in the construction industry, the NLRB concluded that they constituted a single employer because of common management and common ownership.  This ruling follows the January 16 ruling by a federal court in California that two additional companies under the common control of one individual were jointly liable for the $1.7 million th ...
