ARE YOU READY TO PAY OVER $162,000.00 IN OSHA FINES? On August 29 a federal judge ordered a general contractor to pay penalties of $162,150.00 as a result of failing to follow OSHA regulations, reports Bill Harding, Chapter Attorney. The contractor must also retain an independent safety consultant with substantial construction industry experience to monitor safety conditions during unannounced worksite visits which will take place twice a week. The contractor must also have a foreman, manager or conusltant who has completed OSHA's 30-hour construction safety course supervise work on all of the company's worksites. Finally, the company must have all employees complete OSHA'S 10-HOUR Construction Safety Course and notify OSHA of every construction project in the future which is projected to take more than one week to complete. Early in the Obama Administration, OSHA announced that the construction industry was "an industry of interedst." The requirements of this federal district court order give a pretty good indicatio of the type of penalties OSHA will be seeking if construction industry employers are found to be in violation of OSHA regulations.
